1.    Right of withdrawal

Consumers are entitled to a statutory right of withdrawal.

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. by email or letter).

To meet the deadline, it is sufficient that you send the notice of withdrawal to us in due time:

So that you do not have to bear the return costs yourself, please contact webshop@biogents.com and you will then receive a return label from us by email (this only applies within the EU; 6 kg CO2 cylinders from SodaBär are excluded, see point 3).

2.    Consequences of withdrawal

If you withdraw from this contract, we will reimburse all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received notice of your withdrawal.

For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods.

You must send back or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal.

3.    Special information on returning CO2 cylinders (dangerous goods)

The statutory right of withdrawal remains unaffected by the following provisions.

The CO2 cylinders offered (in particular 6 kg CO2 cylinders) are dangerous goods within the meaning of the applicable ADR transport regulations.

3.1 Return logistics

Returns are handled within the framework of our dropshipping and logistics process via our partner SodaBär (info@sodabaer.de), who coordinates the retrieval of dangerous goods.

The return is therefore:

·        only possible in the original packaging

·        only possible after prior coordination with SodaBär

·        only possible via approved dangerous goods transport service providers

·        only possible with the corresponding organizational and logistical clearance

3.2 Return costs

The direct costs of return shipment shall be borne by the customer.

These costs vary depending on the destination country and logistical distance:

·        Germany: €29.90

·        EU Zone 1 (Austria, Belgium, Czech Republic, Denmark, Luxembourg, Netherlands, Poland): €39.90

·        EU Zone 2 (Bulgaria, Croatia, Estonia, Finland, France, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden): €59.90

·        Switzerland: €59.00

·        Europe non-EU (Albania, Bosnia and Herzegovina, Liechtenstein, Moldova, Montenegro, North Macedonia, Norway, Serbia, United Kingdom): €69.90 + €27.90 customs clearance costs Unpaid or uncoordinated returns may be refused for safety and logistical reasons.

3.3 Conditions for return

A return of CO2 cylinders is only possible if:

·        the cylinder is undamaged

·        no safety-relevant modifications have been made

·        the return has been coordinated with SodaBär in advance

3.4 Compensation for diminished value

You only have to pay for any diminished value of the goods if this diminished value results from handling that was not necessary to examine the nature, characteristics and functioning of the goods.

This applies in particular to CO2 cylinders if they:

·        have been partially or completely emptied

·        have been handled improperly

4.    📄 Voluntary return policy (30 days)

Irrespective of the statutory right of withdrawal, we grant you a voluntary return policy of 30 days from receipt of the goods.

Requirements:

·        undamaged goods

·        return in original packaging

Exclusions:

The following are excluded from the voluntary return policy in particular:

·        CO2 cylinders (6 kg), regardless of whether they are:

o   in original packaging

o   connected

o   partially or completely emptied

Return costs under the voluntary return policy:

Biogents bears the return costs under the voluntary return policy.

Note

Statutory rights, in particular the statutory right of withdrawal, remain entirely unaffected by the voluntary return policy.

 

5.    Warranty

 

Warranty is provided in accordance with the statutory provisions. The statutory warranty period is 24 months, calculated from delivery of the goods.
If the goods have a technical defect, you may request subsequent performance (remedy of defects or replacement delivery). If subsequent performance fails, you may withdraw from the contract in the case of a material defect, reduce the purchase price or claim damages. You are obliged to enable us to inspect the defective delivered item.

To the extent permitted by law, any further warranty for material defects and defects of title is expressly excluded.

 

6.    Liability

Biogents AG accepts no liability for damage resulting from improper or careless handling of the delivered goods. Please also observe the instructions enclosed with the goods.
