In addition to the legal regulations between the company Biogents AG and the purchaser, the following General Terms and Conditions exclusively apply to the relevant version valid on the date of purchase. Any alternative conditions stipulated by the purchaser shall be valid only if expressly acknowledged by us in writing.

The Biogents Online-Shop is focused on private customers. Merchants, companies, judicial persons under public law, or trustees of public funds should address their enquiries directly to the company Biogents AG at the address stated above.

 

2. Sales Agreement

All products, services and prices shown in our online shop are not legally binding. More accurately it represents a non-binding Online Catalogue. After entering all personal contact information and by clicking the "order now" button on the order confirmation page, the order is considered binding. You will receive order confirmation immediately after the order process has been completed. The sales agreement is valid as soon as the delivery confirmation is sent. If you do not receive confirmation or the actual delivery within two (2) weeks, you are legally no longer bound to your purchase.

 

3.1 Prices and shipping costs

All prices include VAT. For the invoice of customers residing outside of the European Union there is the possibility of choosing “Non EU country” as the tax territory. In this case, the VAT is not calculated in.

Additional costs accumulate for shipping and are also implemented in your shopping cart.

 

3.2 Partial Delivey

We are authorized to send partial deliveries as long as it reasonable for the buyer. Additional shipping costs accrue only with an express agreement.

 

3.3 Payment Terms, Reservation of Proprietary Rights

Within the order transaction, you have the option of choosing between different methods of payment.

The supplied products remain our property until the payment has been completed.

 

4.1 Cancellation Policy

Any customer has the right to revoke his/her contractual statement, without justification, within four (4) weeks of receipt of the goods as long as you send your cancellation in writing (letter, fax, or e-mail to webshop@biogents.com) or if you return the goods to us. If you are a professional buyer or freelancer the current statutory provisions for the return of goods shall apply. Please note there is a different address where the goods should be sent to.

The time frame for the cancellation period begins as soon as you have received a receipt of the products and detailed instructions in writing. The warranted time frame complies with the timely send off of the cancellation or of the product. The buyer is responsible for all shipping costs related to the return of the goods. 4.2 Cancellation Consequences

In the event of an effective cancellation, both parties shall return any goods or services and/or reimburse payments recieved and, as the case may be, any profits from the deal (i.e. interest). If you cannot reimburse the recieved goods to us in full or only in a declined condition, you must pay us compensation as the case may be. This does not apply if the cause of the impairment of the product is solely based on the primary inspection, which could have been performed at the retail store. You can avoid the obligation to pay compensation by not using the product as if it was your own property and by refraining from any action that might impair the product. The return shipment of the product is carried out under our risk. We will refund only product amount and not shipping costs.

To avoid having to bear the return costs yourself, please contact webshop@biogents.com, and you will then receive a return label from us by e-mail (this only applies within the EU).

 

5. Warranty

The warranty in the European Union is based on current statutory provisions and legal requirements. This implied warranty in the European Union is good for 24 months from the date of shipment of the products. Additional information about manufacturer’s warranties can be found on the product pages or in the product manuals.

If the product contains a defect in workmanship or material, then the customer has a right to request supplementary performances, such as removal of the defect or the shipment of a replacement part, provided that the purchaser has promptly reported the defect to Biogents in writing. If you have an extensive defect and the supplement performances fail, you can withdraw from the agreement and the purchase price will be reduced or compensation will be asserted; however, you are obligated to allow us to inspect the defective product.

Every other title and quality warranty will be formally excluded as legally possible.

6. Liability

Biogents AG repudiates all liability for damages that arise from the improper or negligible handling of the delivered product. Please observe the enclosed information of the product. You can reach our customer support by e-mail at: webshop@biogents.com.

 

7.1 Collection and Processing of the Data

According to § 28 of the Federal Data Protection Law (Bundesdatenschutzgesetzes) we advise you that the necessary data will be processed and stored during the transaction via a computing system, according to § 33 of the Federal Data Protection Law.

When paying with a credit card, the information is encrypted (secured socket layer) and goes directly to Shopify Payments. Shopify Payments is a secure internet based financial institution that offers payment services that are specifically arranged for Biogents AG credit card transfers. Shopify Payments guarantees that the data will be exclusively utilized only for the purchase transaction. Biogents AG does not obtain any of your credit card information.

Cookies will be used for the purchase order processing, so that when the browser is closed it will be cleared of all information.

It is possible that we analyse the web traffic of visitors for the purpose of improving our website. However, absolutely no data that can personally identify the visitor will be used or stored.

Personal data will only be stored when you willingly provide this data within a request, registration, or an order.

 

7.2 The Use and Transfer of Personal Data

When you provide us with your personal data, we will only use this data to reply to your inquiries, to handle your closed contracts, and for technical administration.

Your personal data will only be relayed to a third party or otherwise conveyed, when it is essential for the purpose of improving, in particular, the transfer of order information to the distributors or when it is essential for the payment purposes or if you have previously given consent. You are entitled to cancel an issued consent for future pruposes at anytime.

The deletion of stored personal data is carried out when your consent for storage is cancelled, when your information is not essential for storage anymore, or when your stored information is prohibited by miscellaneous legal reasons.

 

7.3 Right of Access

We would be happy to inform you about your stored personal data with a written request.

 

7.4 Security Advice

We go to great lengths to ensure that through the siezure of all technical and organizational possibilities, your personal data is stored so that is it not accessible to a third party. We cannot guarentee the complete data security from us via e-mail communication so we recommend that we send all confidential information by mail.

 

8. Final Clause

German law shall apply, excluding the United Nations Convention on the International Sale of Goods, also if the purchase order is made from another country or if the product is sent to another country.
